RENT DEED

This rent deed is executed on this day of …………….2018 between :–

…………………………………………………………….w/d/s/o Sec-………..Panchkula owner of House No-……….., Sector-……, hereinafter referred to as owner and includes her heirs, successors and assigns on One part,

AND

Shri ………………………………… s/o Shri …………………………..having permanent address as stated by him……………………………………………………..as per Voter Card ……………….dated………………… his PAN Card No is, copies of both attached to this deed, hereinafter referred to as tenant and includes his heirs, successors and assigns on Second part. The tenant is an employee of ………………………………………………………………. and his status as such employee in a transferable job is material and relevant to this deed.

IN respect of ……………..Premise of ……………………………………………, consisting of two bedrooms, one drawing room, one study room, one kitchen, and two toilets, front court yard and excluding all other areas court yards, adjoining rooms, cantilevers etc on the said first floor or anywhere else in the building.

For a period of eleven months starting on……………… to ………………………..For a monthly rental of Rs ………./- (Rs ……………………. only) for the above said rented portion.

The owner and tenant hereby agree as follows:–

1. That the rent will be paid monthly in advance on or before 5th of every calendar month. Tenant has paid security deposit of Rs ………………../ and rent of the first month i.e. Rs …………………../- and owner acknowledges receipt of the same. The security deposit carries no interest and is refundable to the tenant in case he fulfills and discharges all the conditions of this rent deed.

2. That the tenant will pay per Rs 400 per month on account of water bill and share of water pumping motor electricity charges.

3. That the tenant will pay electricity bill at actual reading of his sub meter installed for his portion on each bill occasioned periodically by

calculated per unit at the rate arrived by dividing the total amount of bill divided by units consumed on main meter.

4. That the tenant will use only the external staircase for accessing and commuting between the ground floor and his first floor portion and will have no right to use the any other staircase to any other floor of the building including the roof.

5. That tenant has not been given any parking space for car within the gated building premises however he could park one two wheeler on the ground floor.

6. That the tenant will at all times during the term of this rent deed keep and maintain the rented premise clean, tidy, healthy, wind and watertight in all seasons and further in good and substantial repair, reasonable wear and tear.

7. That the rented premise has been fitted with new kitchen chimney, one window air conditioner, LED lights, fans, geyser and sanitary fittings of very good quality in absolutely working condition by the owner and the tenant will replace the broken fittings and fixtures which got damaged during his usage by equally good or better quality substitutes. The tenant will not make any structural additions or alterations to the rented premises.

8. That after the expiry of the rent period i.e……………. the tenant will hand over the vacant possession of the rented premises to the owner in same condition in which he had taken over except for reasonable wear and tear.

9. That tenant fully understand and acknowledges the fact that handing over the vacant possession of the rented premise on expiry of the term of the rent deed i.e. on……………. is of great importance to the owner since she requires the premise for her own use thereafter.

10. That tenant will permit the owner, his servants, and agents at all reasonable hours to enter into the rented property to inspect the condition or to leave notice of all defects to be repaired.

11. That the tenant at all times during the term of tenancy shall use and occupy the rented property for himself and the members of and not to keep any paying guests or share accommodation with outsiders nor to carry on or permit to be carried on any trade, business, or service from the rented premises.

12. That the tenant shall not assign or part with his rented premise or interest in the said premises created under these presents nor sublet the same or any part thereof to any person or persons whomsoever, or make any structural addition or alteration therein.

13. That either party shall have the right to terminate this rent deed before its due date of completion by giving one month’s notice.

14. That on expiration or earlier determination of this deed the tenant shall yield and deliver peaceful vacant possession of the premises in its entirety together with all improvements if any done thereto without any claim for compensation on that account.

15. That the tenant, paying the rent hereby reserved and observing and performing the conditions and covenants herein contained, shall quietly and peaceably hold, possess and enjoy the said premises during the said term without any interruption and disturbance by the owner or any person claiming under or in trust for him: PROVIDED, however, and is expressly agreed and declared by and between the parties hereto, that in case of non payment of rent for any month beyond 2(two) days from date fixed OR in the event of breach of any of the conditions and covenants to be observed and performed by the tenant, this deed may at the option of the owner stand determined where and in such event the owner shall be entitled to re enter into the property and repossess the same as his former estate without prejudice to his right to recover all arrears of rent and any damages for breach of such conditions and covenants.
